Brazil State of Catarina Must Pay for RSHO – Local Judge

A Florianópolis merchant was granted three monthly bottles of pure cannabidiol (CBD) hemp oil for an indefinite period of time.

A Federal Court in Brazil has ruled that a merchant in the state of Santa Catarina must be provided regular shipments of the cannabidiol (CBD) hemp oil product Real Scientific Hemp Oil™ (RSHO™) paid for by both the state and the nation. The ruling comes nearly three years after Brazil’s health regulatory agency, the National Sanitary Surveillance Agency (Anvisa), removed CBD from its list of prohibited substances and allowed importation of CBD in exceptional cases.

After traditional antiepileptic treatments proved ineffective, the Florianópolis resident, who remains unnamed filed a lawsuit in the Federal Court of Florianópolis to get access to CBD hemp oil, a non-psychoactive cannabis oil made from high-CBD, low-THC hemp. The suit argued that access to the CBD oil was guaranteed under the Brazilian Constitution, which states that everyone has the fundamental right to health.

The judge in that case ruled that it was not for the judiciary to intervene in cases related to the Unified Health System and that doing so would breach budget law. The lawsuit was dismissed, prompting the man to appeal to the higher court.

The merchant had reportedly been taking RSHO™ for two months. In his appeal, he argued that the use of RSHO™ CBD oil was essential to his health.

Federal judge Rogerio Favreto of the Federal Regional Court of the 4th Region agreed with the man, stating that judicial interference was in fact necessary in exceptional cases. Favreto ordered Santa Catarina and Brazil provide him with three monthly bottles of RSHO™ 18% CBD oil for an indefinite period of time.

This is the third time that the Santa Catarina Federal Court has ordered the state and nation to provide free CBD treatments. This past July, a child from Blumenau was awarded CBD oil. In February 2015, the court ruled that a young woman from Dionisio Cerqueira was entitled to CBD.
